Introduction

Website Policies

  1. ASSURED PARDONS OF CANADA helps its customers navigate the bureaucracy associated with the filing and processing of applications for pardons, U.S. entry waivers and file destructions. We do not provide legal advice. Should you require legal assistance please consult a lawyer.
  2. ASSURED PARDONS OF CANADA guarantees you our best efforts in assisting you with your Pardon and US Entry Waiver applications as well as file destruction services. We reserve the right to reject any application.
  3. OUR PARDON GUARANTEE: If your pardon is not granted by the National Parole Board, Assured Pardons of Canada will fully refund your fees. The guarantee is subject to restrictions as set out in the Assured Pardons of Canada Guarantee.
  4. Assured Pardons of Canada cannot give guarantees of any sort for a US Entry Waiver. Theses services as identified on the Assured Pardons of Canada website are prepared on a ÒBest Efforts BasesÓ and carry no guarantee whatsoever.
  5. By completing an on-line application you authorize Assured Pardons of Canada to start working on your behalf. All fees for our services become due immediately unless you have made other payment arrangements with Assured Pardons of Canada. If a payment plan is arranged, monthly payments will automatically be charged on your account without prior notice to you.
  6. Assured Pardons of Canada will work diligently but cannot guarantee a timeframe when you will receive your results as these are based on the response times of the involved government agencies.
  7. Non-payment of fees in a timely manner may result in your file being placed on hold unless you have made other payment arrangements with Assured Pardons of Canada. It may take up to 30 days for your file to be resumed after a late payment has been made, and a late fee may be applied to your account.
  8. All fees are subject to change without notice.
  9. Your confidentiality is guaranteed. All of your information is kept in secure files and will never be sold or rented to other interests. See Privacy Policy for more detail.
  10. Once Assured Pardons of Canada has received any form of payment; all fees, disbursement costs and charges paid to Assured Pardons of Canada are considered non-refundable.

The Assured Pardons of Canada Guarantee

Assured Pardons of Canada guarantees to obtain a pardon on your behalf or the service fee will be refunded in full, minus any service fees.

Service fees do not include:

  • National Parole Board fees
  • Local police check fees
  • Court fees
  • Fingerprinting fees

The guarantee does not apply if you are found to be involved in criminal activity; or, as a result of our inquiries the RCMP certifies that no criminal record exists.

If you choose to terminate your pardon application for any reason the guarantee does not apply; if it is determined you are not yet eligible for a pardon, we will maintain your file and resume your application when you are eligible. The guarantee will still apply.

Disclaimer

You expressly acknowledge that Assured Pardons of Canada has entered into this agreement, and has and will make this Assured Pardons of Canada website, Content and Services available to you in reliance upon the limitations and exclusions of liability and the disclaimers set forth herein, and that the same form an essential foundation of the agreement between you and Assured Pardons of Canada. Termination

You acknowledge and agree that Assured Pardons of Canada, in its sole and absolute discretion, may, without notice to you, suspend or terminate your account or your use of, or access to, this Assured Pardons of Canada website or any of the Services, and remove and discard any information or content related to this Assured Pardons of Canada Site or any of the Services (and your use thereof), for any reason, including where Assured Pardons of Canada believes that you have violated any of these Terms and Conditions. You further agree that Assured Pardons of Canada shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with this Assured Pardons of Canada Site or any of the Services or with any terms, conditions, rules, policies, guidelines, or practices of Assured Pardons of Canada in operating this Assured Pardons of Canada website or any of the Services, your sole and exclusive remedy is to discontinue using this Assured Pardons of Canada website or any of the Services.

Arbitration and Actions

Any controversy, claim or dispute arising out of or relating to these Terms and Conditions, your use of this Assured Pardons of Canada website or Service or the relationship which results from these Terms and Conditions, including without limitation, the performance, breach, enforcement, existence or validity of the matters provided for in these Terms and Conditions which cannot be amicably resolved, even if only one of the parties declares that there is a difference (collectively, a "Claim"), will be referred to and finally settled (to the exclusion of the courts) by private and confidential binding arbitration before a single arbitrator held in Vancouver, British Columbia in English and governed by British Columbia law pursuant to the Commercial Arbitration Act, as amended, replaced or re-enacted from time to time. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Canada and is independent of either party. Any such Claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim, controversy or dispute of any other party. You agree to waive any right you may have to commence or participate in any class action against us related to any Claim and, where applicable, you also agree to opt out of any class proceedings against us. Notwithstanding the foregoing, we reserve the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

General Provisions

This agreement is personal to you, and you may not assign your rights or obligations to anyone. These Terms and Conditions constitute the entire agreement between Assured Pardons of Canada and you pertaining to your use of this Assured Pardons of Canada website, Services and Content and supercede any prior agreements between you and Assured Pardons of Canada with respect to the subject matter hereof. Assured Pardons of Canada's failure to insist upon or enforce strict performance of any right or provision of these Terms and Conditions shall not constitute or be construed as a waiver of any right or provision. If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein. No changes to these Terms and Conditions shall be made except by a revised posting on this page or except as otherwise expressly contemplated herein. The parties have required that these Terms and Conditions and all documents relating thereto be drawn up in English.
